Jakkur Technoparks Private Limited (“JTPL”, “Nearshop”, “we”, “our”, or “us”) respects your privacy and is committed to protecting your personal information. This Privacy Policy explains how we collect, use, share, and safeguard your information when you use the Nearshop Financial Services App (“App”) and related services.

This Privacy Policy is published in accordance with the Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, the Aadhaar Act, 2016 (as amended), the Digital Personal Data Protection Act, 2023, and other applicable Indian laws.

By using our App, you agree to the terms of this Privacy Policy. If you do not agree, please refrain from using the App.

1. Our Role

Nearshop is a technology platform provider, registered as a Buyer Network Participant (BNP) on the ONDC platform. We do not provide loans or credit directly. All loans are provided solely by our registered NBFC/Bank partners in compliance with RBI regulations.

2. Information We Collect

a) Personal Identification Data

• Name, address, email, phone number, date of birth, gender, PAN, employment type (optional), and company name.

b) Identity and KYC Data

• Aadhaar, voter ID, or other government-issued identification documents.
• Photos, videos, or biometric verification data (such as fingerprint or face verification, if required).

c) Financial Information

• Bank account details
• Income documents
• Credit-related information as required by lending partners

d) Location Data

• Collected only with user consent (GPS or network-based), used for KYC verification and fraud prevention.

e) Device Information

• IP address, device identifiers, operating system, and usage logs.

f) Camera/Media Data

• Photos, live images, or videos captured during KYC verification.

g) Installed App Access (for eMandate Registration) with explicit consent, the App may request access to check if certain banking apps are installed on your device.

• This is required only to redirect you for eMandate registration.
• The App will not collect data about other installed applications unrelated to this process.
• These permissions are requested only for loan processing and regulatory compliance. They are not used for any other purpose, and the App does not collect or access information about unrelated applications.

3. How We Use Your Information

• To connect you with our NBFC/Bank partners for loan facilitation.
• To complete mandatory KYC and identity verification.
• To process loan applications and communicate status updates.
• To comply with RBI and other regulatory requirements.
• To enable secure eMandate setup for repayments.
• To prevent fraud, unauthorized access, or misuse of the App.
• To improve our App’s functionality and user experience.

We do not use your data for advertising, marketing, or unrelated analytics.

4. Sharing of Information

We share your information only with:

• Registered NBFC/Bank partners (such as IFPL) for loan processing. Authorized third-party service providers (KYC agencies, credit bureaus, account aggregators, payment processors).
• Regulatory authorities as required by applicable laws.

We do not sell or share your information with advertisers or third parties for marketing purposes.

5. Consent for Credit Information and Account Aggregator (AA) Access

Users are required to provide explicit consent for:

• Credit Information Access: To fetch your credit bureau data for loan assessment.
• Account Aggregator (AA) Access: To securely share your financial data with lenders under the RBI AA framework.

This access is solely for loan assessment purposes and is subject to explicit user approval.

6. Loan Disclosure

Loan products offered via this App are provided by our NBFC/Bank partners.

• Loan amount, tenure, interest rate (APR), processing fees, and other charges will be disclosed before you confirm a loan application. No hidden fees will be charged.
• Disbursements and repayments flow directly between the borrower’s and lender’s bank accounts (per RBI Digital Lending Guidelines).

7. Data Retention

• Loan and KYC records are retained for 5 years after the end of the customer relationship or as mandated by RBI, whichever is longer.
• Once the retention period expires, data is securely deleted or anonymised.

8. User Rights

You have the right to:

• Access and review your personal information.
• Request correction of inaccurate or incomplete data.
• Withdraw consent for optional permissions (location, camera, installed app check).
• Request deletion of your data, subject to regulatory retention requirements.
• Request portability of your data in a machine-readable format.

9. Security of Data

We use industry-standard security practices, including:

• Encryption of data in transit and at rest.
• Limited access restricted to authorized personnel.
• Compliance with RBI’s IT and security guidelines.
• Regular audits and monitoring.

10. Eligibility

Our App and services are intended only for users who are 18 years of age or older. If we learn that we have inadvertently collected data from a minor, we will delete it immediately.

11. Changes to this Policy

We may update this Privacy Policy from time to time. Updates will be posted on our App/website with the revised effective date.
